DEFINITIONS

“We”, “us” and “our” means Applecross Farm.

“You” means the person using our site and purchasing goods.

“Site” means our website at https://www.applecrossfarm.com/.

“Goods” means the products listed for sale on the Site.


ELIGIBILITY AND ACCOUNT REGISTRATION

  • You must be at least 18 years old to create an account or place an order.
  • You are responsible for keeping your account credentials confidential and for all activity on your account.
  • Information you provide must be accurate and kept up to date.
  • We may suspend or close accounts at our discretion if we suspect misuse or a breach of these terms.

ORDER PROCESS

  • Your order is an offer to buy Goods from us. We will confirm receipt by email. This is not acceptance.
  • Acceptance occurs when we dispatch the Goods and send a dispatch confirmation email. A contract is formed at that point.
  • If we cannot accept your order, we will let you know and will not charge you or will refund any amounts taken.
  • Please check your order carefully. You can correct errors before payment at checkout.

PRICES, TAXES AND PAYMENT

  • Prices are shown in GBP and include VAT where applicable unless stated otherwise.
  • Delivery charges are shown at checkout and vary by destination and service.
  • We take payment by credit card, processed securely by Square (“Square”). Card details are submitted directly to Square. We do not store full card numbers, security codes or Stripe-equivalent tokens on our systems.
  • Payment is taken at the time you place your order. For pre-orders or backorders we may take payment when the item is ready to dispatch.
  • We try to ensure prices are correct, but if we discover an error we may cancel the order and refund you, or contact you to give the option to continue at the correct price.

DELIVERY

  • Available delivery options, costs and timeframes are shown at checkout.
  • Timeframes are estimates. We are not responsible for delays outside our control.
  • Risk in the Goods passes to you on delivery. Title passes when we receive full payment.
  • If a parcel is returned to us due to an incorrect address or failure to collect, we may charge for redelivery.

CLICK AND COLLECT/LOCAL PICK UP

  • You will receive a notification when your order is ready to collect.
  • Bring photo ID and your order number. We may refuse release if we cannot verify identity.
  • Orders not collected within [7] days may be cancelled and refunded minus any reasonable costs.

RIGHT TO CANCEL – CONSUMER CONTRACTS REGULATIONS 2013

  • If you are a consumer, you have a legal right to cancel most online orders within 14 days without giving a reason.
  • The cancellation period ends 14 days after the day you, or a person you nominate, receives the Goods.
  • To cancel, inform us of your decision within the cancellation period using the contact details above. You can use the model cancellation form below, but it is not required.
  • You must return the Goods within 14 days of telling us you wish to cancel, at your cost, using a tracked service. You must take reasonable care of the Goods.
  • We will refund the price paid, including the standard delivery cost, within 14 days of receiving the Goods back or receiving proof of return. We may deduct for any diminished value resulting from unnecessary handling.
  • The right to cancel does not apply to certain Goods, including sealed items not suitable for return for health protection or hygiene reasons if unsealed, personalised or made to order items, and perishable goods.

FAULTY GOODS – CONSUMER RIGHTS ACT 2015

  • If Goods are faulty or not as described, you may be entitled to a repair, replacement or refund.
  • Contact us as soon as possible with your order number, a description of the issue and photos if relevant.
  • This does not affect your statutory rights.

RETURNS POLICY – NON FAULTY

  • In addition to your legal rights, we offer the following returns policy: [state time window, conditions, any restocking fees].
  • Items must be unused, in original packaging with all tags and accessories.

PROMOTIONS AND DISCOUNT CODES

  • Promotions are subject to additional terms. We may withdraw or amend promotions at any time.
  • Only one discount code may be used per order unless stated otherwise. Discount codes have no cash value and may expire.

USER REVIEWS AND CONTENT

  • If you post reviews or other content, you grant us a non exclusive, royalty free, worldwide licence to use, reproduce and display that content on the Site and in marketing.
  • Do not post anything unlawful, harmful, defamatory, obscene, infringing, or misleading. We may remove content at our discretion.

ACCEPTABLE USE

You agree not to:

  • Use the Site in any way that breaches applicable law.
  • Interfere with or disrupt the Site, servers or networks.
  • Attempt to gain unauthorised access to any part of the Site or data.
  • Use the Site to transmit malware, spam or unsolicited communications.

INTELLECTUAL PROPERTY

  • All content on the Site, including text, graphics, logos, images, product names, and software, is owned by us or our licensors and is protected by intellectual property laws.
  • You may use the Site for personal, non commercial purposes only. You must not copy, reproduce, modify or distribute any content without our permission.

PRIVACY AND COOKIES

  • Please read our Privacy Policy and Cookie Policy which explain how we collect and use your personal data and how the Site uses cookies and similar technologies.
  • By using the Site you acknowledge these policies.

PERSONAL DATA AND GDPR/UK GDPR

This section summarises how we handle personal data when you use the Site, register an account and place orders. It is intended to sit alongside – not replace – our full Privacy Policy.

Controller

  • Applecross Farm is the controller of personal data collected via the Site.

What data we collect

  • Identity and contact data – name, billing and delivery addresses, email, phone.
  • Account data – login, profile, order history, saved addresses, preferences.
  • Transaction data – order details, prices, taxes, refunds.
  • Payment data – handled by Square. We receive limited payment status information, last 4 digits and card brand where necessary.
  • Technical and usage data – IP address, device, browser, log data, cookies, analytics.
  • Communications data – messages, reviews, customer service notes.

Legal bases for processing

  • Contract – to register your account, take and fulfil orders, provide customer service.
  • Legal obligation – VAT records, consumer rights handling, fraud prevention, regulatory reporting.
  • Legitimate interests – to run and improve the Site, prevent abuse, personalise content, measure performance, send service messages.
  • Consent – for optional cookies/analytics and direct marketing by email or SMS where required. You can withdraw consent at any time.

Payments via Square

  • We use Square to process payments. Your payment details are provided directly to Square and are processed according to Square’s terms and privacy notice. Square may process your data as our processor and, for some activities such as fraud prevention and compliance, as an independent controller.
  • We receive confirmation of payment, refunds and limited card details. We do not store or have access to your full card numbers or security codes

THIRD PARTY SERVICES

  • We use third party providers such as payment processors and delivery companies. Their terms and privacy policies apply when you use their services.
  • The Site may contain links to third party websites. We are not responsible for their content or policies.

LIMITATION OF LIABILITY

  • Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
  • Subject to the above, we will not be liable for any loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, or any indirect or consequential loss.
  • Our total liability to you for any loss or damage arising out of or in connection with the contract shall be limited to the total price paid for the Goods.

EVENTS OUTSIDE OUR CONTROL

  • We are not responsible for delays or failure to perform where this is due to events outside our reasonable control. If such an event occurs, we will contact you as soon as possible to let you know and take steps to minimise the effect.

SUSPENSION OR WITHDRAWAL OF THE SITE

  • We do not guarantee that the Site, or any content on it, will always be available. We may suspend, withdraw or restrict the availability of all or any part of the Site for business and operational reasons.

CHANGES TO THESE TERMS

  • We may update these terms from time to time. The terms that apply to your order are those in force at the time you placed the order.

GOVERNING LAW AND JURISDICTION

  • These terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

COMPLAINTS AND DISPUTE RESOLUTION

  • We aim to resolve complaints quickly and fairly. Please contact us using the details below.
